What Is Patent Prosecution?
Although in the legal world, prosecution typically refers to litigation, patent prosecution actually involves the process of writing and filing a patent application. This process also involves negotiating with the United States Patent and Trademark Office (USPTO) in order to obtain patent protection and rights for an invention.
After the patent application is drafted and reviewed, it has to be determined whether the invention meets patent requirements. It’s a good idea to hire a patent attorney who is experienced with filing patent applications because the whole process can be complicated.
On the other hand, patent litigation is a different procedure that involves addressing patent infringement after a patent is already procured.
What Patent Examination Involves?

In other words, they will have to investigate everything relating to a certain invention for more than a year before the date an individual has applied for the patent.
A patent examiner can approve the patent application or decline it. If a patent application is rejected, the next step in the patent process can be an appeal. A patent prosecutor can appeal the decision of a primary examiner to the Patent Trial and Appeal Board.
